The Indian Government passed the RERA Act in May 2016, following the launch of Pradhan Mantri Awas Yojana Gramin, to enable transparency in the process of home buying. RERA or Real Estate Regulatory Authority aims at developing a transparent real estate industry. There are multiple provisions in the RERA Act for home buyers, one of which is they can file complaints against registered developers, builders, and real estate agents.

As per the RERA Act, committees have been set up across Indian states to ensure uniformity and regulation of the real estate sector. Every builder needs to abide by the rules laid down by RERA. Step 4 – Once it is done, the complainant must pay a fee for the filing. Fees payment can be completed directly through the online mode.

When to file a RERA complaint?

The RERA Act would highly benefit first time home buyers. A home buyer can file a complaint if a registered builder, real estate agent, or developer violates any of the RERA Act’s provisions. Listed below are some conditions under which buyers can file a RERA complaint:

  • Delay in possession delivery: If any builder causes a delay in delivering possession of the buyer’s property, the latter can file a complaint against the former. A complaint can be either to get immediate possession or a full refund along with interest.
  • Fake advertising: If a homebuyer deposits an amount of money with a builder based on being misled through fake advertising, he/she can file a complaint.
  • Advance payment: The permissible limit for advance payment is only up to 10% of the building or plot cost. A buyer can file a complaint against any builder who asks for more than 10%.
  • Inappropriate project registration: All projects must be registered under RERA, even ones built under the Pradhan Mantri Awas Yojana-Gramin. Buyers can file a complaint against builders if they sell or try to sell any unregistered project.

A potential home-seeker must ensure that everything is done ethically regarding the property he/she is interested in, per the RERA rules. PMAY Gramin beneficiaries must be well-versed across the scheme’s rules as well to ensure they do not fall prey to any unethical conduct.
